Town Services Department
The Estate Department in CIDCO is mainly concerned with taking care of all the leases granted by the Corporation in respect of plots as well as built-up premises. The files pertaining to plots as well as built-up premises, reach this department from the Marketing Managers after handing over the possession and execution of Agreement. In respect of all the plots or premises allotted by the Social Services Officer and the Chief Health Officer such files reach the Estate Department after issue of allotment orders and recovery of the lease premium. Thereafter, Agreement to Lease is executed by the Estate Department.
After getting the files as above, the Estate Department is mainly concerned with ensuring compliance of the conditions of Agreements, making of recoveries pertaining to Service Charges wherever applicable, instalments of loans, transfer charges, additional premium etc. For this purpose, this Department is headed by the Manager (Town Services) and he in turn is assisted by four Estate Officers posted in CIDCO Bhavan and eight Asst. Estate Officers with nucleus staff placed at nodal levels viz. Airoli, Koparkhairne– Ghansoli, Vashi, Nerul-Sanpada, CBD-Kharghar, Kalamboli–Dronagiri, Panvel & Railway Commercial Complexes.
The procedure has to be followed for transfer of flats / shops / plots has been given the booklet viz. “Transfer of Property Made Easy” published by the Corporation with a view to guide the Licensee / Lessee i.e. Seller / Purchaser. The Corporation has, with the approval of the Govt. of Maharashtra, prepared the New Bombay Disposal of Land Regulations, 1975 now Navi Mumbai Disposal of Land (Amendment) Regulations, 2008 for the disposal of plots of land in Navi Mumbai, to administer the property and to grant the Lease Deed.
The Corporation carves out suitable plots of land for various uses and disposes off the same in the open market, as well as constructs the apartments for Residential use, shops and offices for Commercial purpose and dispose of the same in the open market. In short, the Corporation disposed of open plots of land, as well as constructed apartments. The process of disposal and administration is being handled in two stages by two departments, i.e. the disposal of plots of land and apartments is being dealt with by the Marketing Department, SEZ Department. The disposal of plots of land for Social, Educational and Religious uses is being dealt with by the Social Services Department.
All these departments dispose of the plots of land/constructed apartments, collect the lease premium/sale price, execute the Agreement to Lease/Agreement for Sale and then send the proposal files to the Estate Department. As such, the functions of the Estate Department begins after the disposal of plots of land/constructed premises and after the execution of the Agreement to Lease.
Functions related to the plots of land
Till 1987, the premises constructed by CIDCO, such as flats, shops, good one, offices etc. were sold under the Maharashtra Ownership Act. From 1987 onwards, we have decided to sell the constructed apartments under the Maharashtra Co-op. Societies Act. The individual owner has to seek our permission for transfer of his unit, on payment of the Transfer Charges. Several other issues such as transfer of constructed apartment to the legal heirs after the death of original allottee, internal court matters, issues pertaining to the property sealed by the Financial Institutions etc. are to be dealt with by the Estate Dept. Considering the total number of apartments in Navi Mumbai, the Estate Dept. has to deal with many such issues daily.
Common Issues
Considering the huge number of CIDCO built up apartments and plots of land, daily we received several applications for various NOCs, as well as court matters. In addition to this, daily we received 10 to 12 applications under the Right to Information Act 2005. The Estate Dept. has to deal with all such issues, as well as to frame various policies to deal with them.
Functioning
For each node in Navi Mumbai, one site office is provided, which is headed by the Asstt. Estate Officer. The execution of the Leave & License Agreement, recovery of the Service Charges, transfer of apartments, issue NOCs pertaining to CIDCO built up premises and deal with the matters pertaining to plots having an area upto 100 m2 (excluding the execution of the Lease Deed) are being dealt with by the Asstt. Estate Officer.
Estate Officers:
The Asstt. Estate Officers work under the control of the Estate Officers. The matter pertaining to the plots of land having an area more than 100.00 m2, as well as the matter pertaining to all other properties including the execution of the Lease Deed, Deed of Apartment, expansion of construction period, various NOCs and transfer are dealt with by the Estate Officers.
