CCUC NAINA

CCUC (NAINA) department has started functioning separately with full flesh staff from 01.01.2018 . The department is headed by the Additional Collector cadre officer and Controller of Unauthorized construction (CUC). This department basically performs dual functions of controlling unauthorized constructions in NAINA area as well as handles all Land relelated matters pertaining to Town Planning Schemes ( TPS) of 23 Villages of IDP and rest of the villages under NAINA jurisdiction. The area under jurisdiction is about 473Km2 comprising of 175 villages and 38 Khopta areas of Panvel, Pen and Uran talukas. The Controller of Unauthorized Constructions (CUC) Department deals with action against unauthorized development/constructions in contravention of the provisions of the Maharashtra Regional & Town Planning Act 1966, especially Sections 52 to 55. The operational set up of the Department is as follows:   Normally, a team consisting of the Surveyors , security guards of MSF and security assistants headed by ACUC keeps on moving in the designated area of Navi Mumbai Airport Influenced Nominated Area ( NAINA) in Raigad district to detect unauthorized constructions. As per CIDCO policy , Surveyors, draftsman and ACUC are delegated officer and powers are delegated to them as per MRTP act-1966. The functions of CUC dept. is as following.

1. Site Inspection:
Site inspection of villages in NAINA jurisdiction is a daily activity of CUC squad. However, if any complaint about any unauthorized construction is received in dept., then in connection with the complaint and as part of the day-to-day work, the surveyors working in the department inspect the site of the actual complaint and submit their self-explanatory site inspection report along with photographs.

2. Notice of Inquiry:
The inquiry notice is issued to give opportunity to builder / developer/ Land owner to prove that he has obtained valid building permission issued by competent authority and the construction is legal. Accordingly, the date and time for submission of documents and hearing is clearly given in writing.

3. Scrutiny letter / Compliance letter:
The documents are scrutinized subject to the prevailing Government Decisions / Circulars / Acts. Also, if there is any error in the documents, a letter of compliance of documents is issued to the concerned builder/ Land Owner and are instructed to submit the necessary and appropriate.

4. Declaration of illegal Structure:
If the concerned builder/ land owner does not respond in any way to inquiry notices or fail to prove his structure as legal then this structure is decided as unauthorized and further administrative process is initiated.

5. Issue notices as per MRTP Act-1966:
The Notices are served under Section 53 (1), Section 54 (1), Section 55 (1) of the Maharashtra Regional and Town Planning Act, 1966, based on the nature of unauthorized construction .

6. Information to Sub-registrar :
The detailed list of unauthorized structures is sent to Sub-registrar office to restrict the registration if illegal structures and safeguard the general people from the financial losses.

7. F.I.R. Filing:
In the relevant case, F.I.R. is filed against the land owner/ builder and accordingly, the charge sheet is approved and filed in appropriate court of law .
8. Caveat filing:
To restrict the applicant from taking undue advantage by getting Stay order in respect of the said property , the Caveat is filed. This process has started to be implemented from November 2019.

9. Eviction campaign:
Final notice is served to the concerned unauthorized construction holders before eviction/ demolition. In case of non-eviction of unauthorized constructions done by the concerned builders / landowner as per the instructions given in the notice issued under MRTP Act, 1966, the eviction / demolition drive is scheduled and carried out by taking Police protection from local police station . Photographs and Video shooting of the eviction drive are also being taken.

10. Press Note:
After carrying out the campaign of unauthorized construction eviction, Hon. A press note is issued to the liaison officer for publicity. Also, the final report in the case, Hon. Is presented to seniors.

11. Reimbursement of expenses of demolition drive / burden:
Also, the details of the expenses incurred in this eviction/ demolition drive are conveyed to competent authority to put the burden on 7/12 of the property in their name or in the name of their respective property.
